When a road traffic accident occurs within the territory of China, it should be reported to the police immediately. When the traffic administration department of public security bureaus handle a road traffic accident, they should inform the litigants of their rights and obligations in handling road traffic accidents stipulated by Chinese laws, regulations, and rules.

In the case of a road traffic accident, the party that is deemed to hold rights to compensation for damages from the party partly or fully responsible may apply to the People's Court for pre-litigation preservation measures. The court may adopt methods such as seizing vehicles or related property in accordance with the law, or may prohibit the responsible party to leave the country. When a road traffic accident occurs, disputes over compensation for personal or property damage can be resolved through negotiations, application for mediation, or civil litigation.
